2. Definitions

In these Terms:

  • “Company” — Oddisey Ltd.
  • “Client” — an individual over 18 years of age or a legal entity placing an order for services via the website www.ukayexpress.com.
  • “Consignment” / “Parcel” — one or more packages sent by the Sender to the Recipient.
  • “Recipient” — the person or organisation receiving the parcel.
  • “Third Party Courier” — external transport and logistics companies engaged by Oddisey Ltd to deliver consignments.

3. Scope of Services

Oddisey Ltd arranges the collection, transportation, and delivery of consignments using its own resources or the services of Third Party Couriers. The Company reserves the right to modify, suspend, or withdraw services and prices without prior notice. Delivery times displayed on the website are estimates and are not guaranteed, as they may be affected by circumstances beyond the Company’s control.

4. Client Responsibilities

  • Provide accurate details of the consignment (weight, dimensions, contents, addresses) and complete the customs declaration form on the website.
  • Accept full responsibility for the accuracy and completeness of the customs declaration. Oddisey Ltd is not liable for errors, incomplete information, or false declarations made by the Client, or any consequences thereof (including delays, fines, confiscation, destruction, or return of the consignment). Incorrect or incomplete information may result in the consignment being destroyed or returned without refund.
  • Provide the full and correct recipient address. Errors will result in the parcel being returned at the Client’s expense without any refund.
  • Ensure secure packaging (double-wall cardboard recommended) and attach all necessary details and labels.
  • Verify current sanctions and restrictions on the import/export of goods to the destination country.
  • Pay all invoices within 24 hours.

5. Customs, Export Control & Sanctions

5.1. General Provisions

All international consignments are subject to inspection by customs authorities, export/import control services, and other governmental bodies authorised to enforce international and national sanctions.

5.2. Client Obligations
  • Review all applicable sanctions regimes, export/import control rules, and customs regulations of the country of origin, transit, and destination.
  • Ensure the consignment does not contain prohibited/restricted goods, technologies, software, materials, or components.
  • Understand restrictions may apply to goods, the destination country, the recipient, the manufacturer, or the use of the goods.
  • Provide complete and accurate customs declarations, invoices, and supporting documents.
  • Submit all required documents to customs authorities on time.
5.3. Liability for Non-Compliance
  • The Client is fully responsible for any violations, including fines, costs, confiscation, destruction, return, delays, and administrative/criminal liability.
  • Oddisey Ltd accepts no liability and does not reimburse any losses arising from Client’s non-compliance.
  • All related costs (fines, storage, return, disposal) must be paid by the Client immediately.
5.4. Rights of Oddisey Ltd
  • Refuse, suspend, or terminate services if violations are suspected.
  • Share Client/shipment data with competent authorities.
5.5. Actions of Government Authorities
  • Customs may open, inspect, detain, confiscate, or destroy consignments.
  • Oddisey Ltd is not responsible for consequences, delays, or losses from such actions.

6. Collection & Delivery

Dates and times provided for collection and delivery are estimates only and are not guaranteed.
The Client must ensure that all required shipping labels provided by the Company are securely attached to the parcel prior to collection or drop-off.
Using unauthorised shipping labels, or sending/handing over a parcel without Company-issued labels, will void any insurance coverage and claims eligibility. In such cases, the Company will not accept liability for loss, damage, delay, or non-delivery of the consignment.
Parcels must not be handed over to any courier or third party without the correct labels. If the Client cannot print the label, they must request an alternative solution from the Company before shipping.

7. Payment

Payment for services can be made via PayPal, credit/debit card on the website before finalising the order, or bank transfer. All payments must be made in full prior to the dispatch of any consignment.
All fees are non-refundable once the parcel has been collected or dropped off, except in cases where the Company is at fault and a refund is approved in writing.
If payment is not received within the specified time, the Company reserves the right to cancel the order, refuse collection, or withhold the release of any consignment until full payment has been made.

8. Surcharges

Upon receipt of a parcel at our warehouse, a comprehensive evaluation of its weight and dimensions is conducted to ensure precise alignment with the quoted prices. Should the dimensions surpass the designated maximum limits for actual or volumetric weight brackets, Oddisey Ltd maintains the prerogative to levy supplementary charges contingent upon the parcel's dimensions.

If the actual or volumetric weight exceeds the paid weight bracket by more than 20 grams, the next higher weight bracket will be applied, plus an administrative handling fee of £2.50.

For oversized parcels:

  • If the sum of the length, width, and height exceeds 180 cm, a surcharge of £20 will be applied.
  • If any one side exceeds 1 metre, an additional surcharge of £20 will be applied.

9. Claims & Liability

9.1. Basic Insurance
  • All consignments are covered by the Company’s basic insurance up to a maximum of USD 100 per consignment.
  • Covers total loss of the consignment during transit only.
  • Does not cover delays, partial loss, damage, confiscation, return, destruction by customs, or any other non-delivery causes beyond the Company’s control.
9.2. Extended Insurance
  • Optional, cost: 5% of the declared value.
  • Covers total loss of the consignment during transit only, up to the full declared value.
  • Declared value must be supported by purchase receipts, invoices, or other acceptable proof of value; otherwise, compensation will be limited to USD 100.
  • Does not cover delays, partial loss, damage, confiscation, return, destruction by customs, or any other non-delivery causes beyond the Company’s control.
9.3. Claim Procedure
  • Claims must be submitted in writing to info@ukayexpress.com or by post to the Company’s registered address.
  • Claims for loss or damage must be submitted within 7 calendar days of the expected delivery date.
  • Claims for late delivery (over 60 days in transit) must be submitted within 14 calendar days after the 60th day.
  • All claims must include supporting evidence (photos, proof of value, shipping documents). The recipient is required to open the parcel upon receipt in the presence of a transport company employee (or the courier, if delivered by courier). In the event of missing items, discrepancies, or visible damage to the contents or packaging, an official report must be completed immediately and signed by the postal worker or courier. Failure to comply with this inspection procedure may result in the claim being declined.
  • Courier inspection and investigation may be required.
  • The investigation process may take up to 3 months.

Each parcel includes limited coverage. Fragile items, such as vases, ceramics, glass, televisions, phones, and other delicate items, are not covered under either basic or extended insurance. Additional (extended) insurance applies only to total loss of the parcel during transit, not to damage or partial loss.

10. Force Majeure

No liability for delays/failures due to events beyond control (natural disasters, war, strikes, government actions, closure of transport routes, suspension of postal/courier services, epidemic restrictions).

12. Cancellation & Refunds

Free cancellation until 20:00 previous day. Rescheduling free. Missed collection + cancellation = £10 fee. Refunds for Company fault within 14 working days. No refunds for returns due to sanctions/customs violations; all costs payable by Client.

12.4. Returns to Country of Origin

In the event that a consignment is returned due to customs refusal, sanctions, recipient refusal, failure of the recipient to collect, or any other circumstances beyond the Company’s control, the return to the country of origin is not guaranteed. If the return is not possible due to legal, logistical, or economic reasons, the consignment may be stored, redirected, disposed of, or destroyed in accordance with the laws and regulations of the transit or destination country. All related costs (including but not limited to storage, disposal, redirection, and administrative fees) are payable by the Client. No refund will be issued in such cases.

15. Limitation of Liability

Oddisey Ltd is not liable for indirect, incidental, consequential, or punitive damages including lost profits, business, or data, from use of services, delays, third parties, customs, sanctions, or force majeure. In no case shall the Company's total liability exceed the amount paid for the shipment or USD 100, whichever is lower.

16. Confirmation of Agreement

Using our services confirms you have read, understood, and agree to these Terms & Conditions.

17. Severability

If any term is invalid, remaining provisions remain in effect.

18. Governing Language

These Terms are in English. Translations are for convenience; English prevails.

19. Entire Agreement

These Terms constitute the entire agreement and supersede prior discussions or understandings.

20. No Waiver

Failure to enforce any term does not waive the right to enforce it later.

21. Sanctions Liability Disclaimer

The Client is solely and fully responsible for ensuring compliance with all applicable international and national sanctions, export control regulations, and customs laws in relation to any consignment. Oddisey Ltd accepts no liability for any fines, losses, confiscations, delays, or destruction of goods resulting from the Client’s failure to comply with such laws and regulations. The Client must bear all associated costs, including but not limited to storage, return shipping, disposal, and administrative fees. Oddisey Ltd reserves the right to share any Client information, shipment details, and related documentation with competent authorities if a violation is suspected or detected.
